These Terms & Conditions apply to every booking and every trip with BootsAndGear — please read them carefully before you book.

1. Introduction

Welcome to BootsAndGear ("BootsAndGear", "we", "our", or "us"). These Terms & Conditions ("Terms") govern your access to our website, social media platforms, WhatsApp communications, and all bookings for trips, tours, treks, activities, and travel services offered by BootsAndGear.

By making a booking, making a payment, using our website, or participating in any trip or activity, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you should not proceed with a booking or use our services.

2. About BootsAndGear

BootsAndGear is a sole proprietorship registered in Dehradun, Uttarakhand, India, and operates various travel experiences across India. Our operational base for most trips is Rishikesh, Uttarakhand.

Our services include, but are not limited to:

  • Backpacking Trips
  • Trekking Expeditions
  • Bike Trips
  • Weekend Getaways
  • Spiritual Tours
  • Family Tours
  • Corporate Tours
  • Student Trips
  • Fixed Departure Tours
  • Customized Tours

3. Eligibility

A booking may only be made by a person who is legally competent to enter into a contract under applicable Indian law.

Participants below 18 years of age may participate only with the consent of their parent or legal guardian. Adventure activities are generally permitted only for participants aged 15 years and above unless otherwise specified.

Participants between 15 and 17 years of age must submit written parental or guardian consent in the prescribed format.

BootsAndGear reserves the right to refuse any booking where eligibility requirements are not met.

4. Booking & Registration

A booking is considered confirmed only when:

  • BootsAndGear accepts the booking;
  • the required Registration Amount or full payment has been received; and
  • a booking confirmation has been issued.

The Registration Amount reserves a participant's seat and is non-refundable.

The remaining balance must be paid within the timeline communicated during booking. Failure to pay the balance by the due date may result in cancellation of the booking.

5. Pricing & Payments

Trip prices include only those services specifically mentioned in the itinerary. Unless expressly stated otherwise, prices do not include:

  • travel insurance;
  • personal expenses;
  • permits not included in the itinerary;
  • meals not mentioned;
  • emergency evacuation costs;
  • additional accommodation due to unforeseen circumstances.

Payments may be made through bank transfer, UPI, payment gateway, or any other payment method approved by BootsAndGear. Applicable taxes shall be charged in accordance with Indian law.

6. Cancellations, Refunds & Rescheduling

Cancellation requests must be submitted in writing through our official communication channels. The Registration Amount is non-refundable.

Refunds, where applicable, shall be governed by the BootsAndGear Cancellation, Refund & Rescheduling Policy, which forms an integral part of these Terms.

Approved refunds may be subject to deduction of the non-refundable Registration Amount, payment gateway or banking charges, actual non-recoverable third-party costs, and deductions permitted under applicable law.

7. Self-Operated & Third-Party Trips

BootsAndGear operates certain trips directly while facilitating bookings for certain destinations through trusted third-party operators.

Where a trip is operated by a third-party service provider, BootsAndGear acts primarily as a booking facilitator unless otherwise stated. Participants will be informed where third-party terms or operational policies apply.

8. Itinerary Changes

Adventure travel is subject to changing weather, road conditions, government advisories, operational requirements, and other circumstances beyond reasonable control.

BootsAndGear may modify routes, accommodations, transport arrangements, departure timings, or itineraries whenever reasonably necessary for operational efficiency or participant safety. Such changes shall not ordinarily constitute a breach of contract.

9. Adventure Activities

Adventure activities involve inherent risks that cannot be completely eliminated. These may include injury, illness, altitude sickness, accidents, equipment failure, wildlife encounters, adverse weather, road conditions, and other natural hazards.

By participating, you voluntarily accept these inherent risks. Participants agree to follow all lawful instructions issued by trip leaders, guides, instructors, and authorised representatives of BootsAndGear.

Failure to comply with safety instructions may result in removal from the activity or trip without refund where reasonably necessary for safety.

10. Medical Fitness

Participants are responsible for ensuring that they are medically fit for their chosen trip. Where applicable, BootsAndGear may require:

  • a medical fitness certificate;
  • health declarations;
  • emergency contact details;
  • blood group information;
  • disclosure of existing medical conditions, allergies, medications, previous surgeries, or other relevant health information.

Providing false or incomplete medical information may result in refusal of participation without liability on the part of BootsAndGear.

11. Participant Responsibilities

Participants agree to:

  • provide accurate information during booking;
  • carry valid government-issued identification;
  • comply with applicable laws and local regulations;
  • respect local culture, customs, religious sites, and communities;
  • take reasonable care of personal belongings;
  • behave respectfully towards fellow participants, staff, guides, and service providers.

Participants remain responsible for any damage caused due to their negligence or misconduct.

12. Code of Conduct

Alcohol, smoking, and recreational drugs are strictly prohibited during trekking expeditions and spiritual tours unless expressly permitted by BootsAndGear.

Harassment, abusive behaviour, violence, discrimination, or conduct that compromises the safety or enjoyment of others may result in immediate removal from the trip without refund.

13. Accommodation, Meals & Transport

Accommodation, meals, and transportation shall generally be provided as described in the itinerary. Room allocation, seating arrangements, and logistics may vary depending on operational requirements.

Special dietary requests will be accommodated where reasonably possible but cannot be guaranteed.

14. Travel Insurance

Travel insurance is strongly recommended for all trips and may be mandatory for certain high-altitude treks or adventure expeditions.

Where insurance is mandatory, it is the participant's responsibility to obtain suitable coverage unless expressly stated otherwise by BootsAndGear.

15. Photography & Media

During trips, photographs and videos may be captured by BootsAndGear or its authorised representatives. By participating, you consent to the use of such photographs or videos for promotional, marketing, educational, and social media purposes unless you notify BootsAndGear in writing before the commencement of the trip.

Where reasonably practicable, BootsAndGear will honour future requests to discontinue the use of identifiable images in new promotional materials. This may not apply to content already published or where removal is not reasonably feasible.

16. Privacy

Your personal information will be collected, processed, stored, and used in accordance with the BootsAndGear Privacy Policy. By making a booking, you consent to such processing as described in the Privacy Policy.

17. Limitation of Liability

BootsAndGear exercises reasonable care in organising trips and selecting service providers.

However, to the maximum extent permitted by applicable law, BootsAndGear shall not be responsible for losses, delays, disruptions, injuries, or additional expenses arising from events beyond its reasonable control, including force majeure events, actions of third-party service providers, government restrictions, or participant negligence.

Nothing in these Terms excludes or limits any rights that cannot be lawfully excluded under applicable Indian law.

18. Complaints & Dispute Resolution

If you have any concern regarding our services, you should first contact BootsAndGear through our official support channels. We will make reasonable efforts to resolve complaints amicably.

If the matter remains unresolved, the parties may mutually consider mediation before initiating legal proceedings. Subject to applicable law, disputes shall be subject to the jurisdiction of the competent courts at Dehradun, Uttarakhand.

19. Amendments

BootsAndGear may revise these Terms from time to time. The version applicable to your booking shall generally be the version in force on the date your booking is confirmed unless otherwise required by law.
